Late rent letter to tenant: templates and sample wording

Sample wording for a friendly rent reminder, a formal late rent letter and a final letter, what you can charge, and why a Section 8 notice is a separate step.

General information for England as at October 2026, not legal advice. Possession rules differ in Wales, Scotland and Northern Ireland, and before serving any notice you should get advice from a solicitor or a qualified adviser.

When rent is late, start with a friendly reminder a few days after the due date, follow with a formal late-rent letter setting out exactly what is owed and a date to pay by, and only then send a final letter before further action. Keep every letter factual, polite and based on your rent record. A late-rent letter is not a notice of possession: a Section 8 notice is a separate legal document with strict rules, and you should get proper advice before using one.

Before you write: check the rent record

  • Confirm the payment really is missing: check the bank, the standing order date and any part payments.
  • Work out exactly which rent periods are unpaid and the total owed today.
  • Check whether Universal Credit housing costs are due to arrive. Since 1 May 2026, amounts unpaid only because a Universal Credit payment hadn't arrived yet are ignored for the main rent arrears possession ground.
  • Check your tenancy agreement. If it allows a late-payment charge, the Tenant Fees Act 2019 caps it at interest of 3% above the Bank of England base rate on the overdue rent, and only once rent is more than 14 days late. Any other late fee is banned.

Stage 1: a friendly rent reminder

Send this a few days after the due date. Most late rent is a mistake, a bank change or a short-term problem, and a friendly message often fixes it.

Hi Sam, just a quick note that the rent of £850 for Flat 2, 14 Mill Road, due on 1 October, hasn't arrived yet. It may simply be a delay. Could you check and let me know when it will be paid? If anything is making it difficult, please tell me and we can talk about it. Thanks, Alex

Stage 2: a formal late rent letter

If there's no reply or payment after about a week or two, send a more formal letter. List each unpaid period, give the total as at today, and set a clear date to pay by.

Dear Sam Taylor,
Rent arrears at Flat 2, 14 Mill Road, Leeds LS6 1AB
Our records show the following rent is unpaid: rent due 1 October 2026, £850.00. Total owed as at 15 October 2026: £850.00.
Please pay this by 22 October 2026 to the usual account. If you can't pay in full, please contact me before then so we can agree a repayment plan. If you think this is wrong, please send me details of the payment.
Free, confidential help with money and rent is available from Citizens Advice and Shelter.
Yours sincerely, Alex Morgan

Stage 3: a final letter before further action

If arrears continue, a final letter tells the tenant plainly what you may do next. It should be factual, not threatening. It is not a legal notice, and it doesn't end the tenancy.

Dear Sam Taylor,
Final letter: rent arrears at Flat 2, 14 Mill Road
Despite my letters of 4 and 15 October, the following rent remains unpaid: 1 October 2026, £850.00; 1 November 2026, £850.00. Total owed as at 5 November 2026: £1,700.00.
Please pay in full, or contact me to agree a repayment plan, by 19 November 2026. If I don't hear from you, I may take further action to recover the arrears, which could include court action. This letter is not a notice seeking possession and does not end your tenancy.
I would strongly encourage you to get free advice from Citizens Advice or Shelter.
Yours sincerely, Alex Morgan

How to send late rent letters

  • Use the method you normally use, such as email, and keep a copy.
  • For the formal and final letters, a PDF or a posted letter (with proof of postage) gives you a clear record.
  • Write to every joint tenant named on the tenancy.
  • Don't contact the tenant excessively, turn up unannounced, change the locks or cut off services. Harassment and illegal eviction are criminal offences.

If the tenant is in Breathing Space

If you're told the tenant has entered the Debt Respite Scheme (Breathing Space), you must stop chasing the debt while it lasts: no contact asking for payment, no interest or charges, and no enforcement or possession action for those arrears. A standard Breathing Space lasts 60 days. Rent that falls due during it should still be paid. See Shelter's guide to Breathing Space.

Section 8 notices are separate

Since 1 May 2026, section 21 "no-fault" notices have been abolished in England, and a landlord who wants possession must use a Section 8 notice on one or more grounds. For rent arrears:

  • Ground 8 (mandatory): at least 3 months' rent owed (or 13 weeks' if rent is paid weekly or fortnightly), both when the notice is served and at the court hearing, with 4 weeks' notice.
  • Grounds 10 and 11 (discretionary): some rent unpaid, or persistent late payment. The court decides whether possession is reasonable.

The notice must be in the prescribed form and served correctly, or the claim can fail. Read the government's grounds for possession guidance and get advice from a solicitor. If you only want the money back, the Pre-Action Protocol for Debt Claims applies to a court claim against a tenant: you must first send a letter of claim with the required information and allow 30 days to reply.

Wales, Scotland and Northern Ireland have different notices and grounds, so don't use English forms there. Tenants who receive a notice can get help from Shelter or Citizens Advice.

Write late rent letters from your rent record

The free DIY Inventory landlord dashboard keeps your rent record and writes all three letters from it: a friendly reminder, a formal late-rent letter (each unpaid period, the total as at today and a pay-by date) and a final letter before further action. You can edit the text, then open it in your email app, copy it, download it as a PDF letter or record it as posted. Every reminder is kept on the property's record with the date sent. It also issues numbered rent receipts: see the rent receipt guide, and the Renters' Rights Act landlord guide for the wider changes.

Questions

How do I write a letter to a tenant about late rent?

Keep it polite and factual: the property, each unpaid rent period, the total owed today, a date to pay by, an offer to agree a repayment plan, and where to get free advice.

Is a late rent letter the same as a Section 8 notice?

No. A letter asks for payment. A Section 8 notice is a formal legal notice seeking possession with strict rules, and you should get proper advice before serving one.

Can I charge my tenant a late rent fee?

In England only if the tenancy agreement allows it, and only interest of up to 3% above the Bank of England base rate on rent more than 14 days late. Other late fees are banned by the Tenant Fees Act.

How many months of arrears before a landlord can evict?

For the mandatory ground 8, from 1 May 2026, at least 3 months' rent (or 13 weeks' for weekly or fortnightly rent) both when notice is served and at the hearing. Other grounds are at the court's discretion.

When should I send a rent reminder?

A friendly reminder a few days after the due date is sensible, then a formal letter if it's still unpaid after a week or two.
